We sell to businesses. These terms apply to a company, not to a consumer. If you are buying as a private person, tell us before you order — different rules apply and we will say so.

Prices are shown without VAT. VAT is added where the law requires it, at the rate in force on the invoice date.
For rail freight, you send us a route and we send back a written offer. There is no contract until we both confirm it in writing.
The subscription runs month to month and renews until you cancel. The report is a single purchase.
Paying for RailX. RailX is sold at railx.eu. Card payments are taken by Stripe Technology Europe, Limited (Dublin, Ireland). We charge the card when you order, and on the same date each month while the subscription runs. If a payment fails we try again and tell you by e-mail. If it fails again we pause the subscription until it is settled.
We invoice in USD. A VAT invoice is issued for every payment and sent to the e-mail address on the account.
The subscription. You may cancel at any time, by e-mail to the address in section 1. The cancellation takes effect at the end of the month you have already paid for. We do not charge a cancellation fee.
The report. Once a report has been delivered it cannot be returned, because it is a one-off written work made for you. If we have not started work, you may cancel and pay nothing.
Where a refund is due, we pay it back the way you paid, within 14 days of agreeing it.
We do the work with the care a professional carrier is expected to use. We tell you promptly if a route changes or a border crossing closes.
We do not promise that a market report will make you money, or that any particular capacity will be available on a given day unless we have confirmed it in writing.
What we are liable for. We are liable for loss we cause by failing to meet these terms. For any claim, our total liability is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for lost profit, lost contracts or other indirect loss.
Nothing here limits our liability for damage caused intentionally. Polish law does not permit that to be excluded — Civil Code (Kodeks cywilny) art. 473 § 2.
Carriage claims. Where we carry goods by rail, the international rail conventions apply in addition to these terms: CIM (Appendix B to COTIF) on the EU side, and SMGS east of the border. Those conventions set their own limits and time bars for loss, damage and delay, and they take precedence over this section for the carriage itself.
Events outside our control. Neither side is liable for failing to perform because of war, a closed border crossing, an infrastructure failure, a strike, an act of a public authority or another event it could not reasonably control. We tell you as soon as we know, and we agree a new date or cancel without penalty.
If we change these terms we change the date at the top. For the subscription, we tell you at least 30 days before a change takes effect, and you may cancel before it does.
